As ESOS stems from the EU’s Energy Efficiency Directive, will it still apply to UK businesses when the UK leaves the EU in spring 2019? The simple answer is “Yes!”
The earliest the UK will leave the EU is 29 March 2019, by which point the deadline for compliance with Phase 2 of the scheme will be only 8 months away. There are up to 10,000 organisations that need to comply with ESOS, so by this time many will have compliance in hand.
Lydia Burdett, Environment Manager at Capita Real Estate and Infrastructure says “In 2016 the UK set a domestic target to reduce energy consumption by 57% by 2030 on 1990 levels, which is tougher than the carbon emission targets the UK is signed up to as a part of the EU. ESOS is a key piece of legislation to help the UK achieve this target, so it is inconceivable that the government would choose to scrap ESOS ahead of the Phase 2 compliance date”.
Won’t the Great Repeal Bill remove EU laws?
This Bill will convert all existing EU laws, as they apply in the UK, into domestic law on the day we leave the EU. This means that the same laws will apply immediately before and after we leave the EU to ensure a smooth transition.
The Bill states: “The Government is committed to ensuring that we become the first generation to leave the environment in a better state than we found it … The Great Repeal Bill will ensure that the whole body of existing EU environmental law continues to have effect in UK law”.
Environmental legislation is increasingly important, and rules which aim to reduce energy consumption and improve efficiency are paramount to the UK meeting targets and protocols that we have signed up to regardless of EU membership, so all EU environmental laws will be kept by the Great Repeal Bill, and ESOS will become UK law.
